Club Waiver and Media Release: Ensuring Safety and Consent
At OwnPace Run Club, the safety and well-being of our members are paramount. As such, we require all participants to complete a Club Waiver and Media Release form. This text aims to clarify the purpose of these documents, emphasizing the importance of ensuring a safe and enjoyable environment for everyone involved in our sports club.
Enhancing Transparency, Consent, and Member Experience
The Club Waiver and Media Release documents serve two crucial purposes for OwnPace Run Club. Firstly, the Club Waiver ensures that everyone involved in our activities is aware of the potential risks and takes responsibility for their personal safety. It allows the club to operate within legal boundaries and provides a measure of protection for both participants and organizers. Secondly, the Media Release enables us to capture and share moments of teamwork, achievement, and camaraderie within the club community. By gaining consent for the use of media, we ensure that our members have control over their likeness and can actively contribute to the promotion of our club. This transparency strengthens the trust we have with our members and enhances the overall experience of being part of OwnPace Run Club. CLUB SAFETY GUIDELINES & RUN ETIQUETTES
General
Must be 18 and up to participate (unless waiver is completed by parent/guardian)
If it’s dark outside, please wear a reflective belt/gear and/or lights for visibility
When nearby roads, never assume that the driver and other modes of transportation see you. Make eye contact or use verbal communication to make sure others are aware of your presence.
Move at your own pace and stay hydrated!
OwNpace run CLUB WAIVER
I agree that I am voluntarily engaging in activities with OwnPace Run Club (“OP RC”), and I know that running in and volunteering for organized group runs with OP RC and its social events, runs, and races (collectively, “events”) are potentially hazardous activities which could cause injury or death. I will not participate in any OP RC events, unless I am medically able and properly trained. By my agreement, I certify that I am in good health and medically able to perform and participate in all events.
I ASSUME ALL RISKS ASSOCIATED WITH ANY EVENT INCLUDING WITHOUT LIMITATION, FALLS; CONTACT WITH OTHER PARTICIPANTS; THE EFFECTS OF THE WEATHER, INCLUDING, WITHOUT LIMITATION, HAIL, HIGH HEAT AND/OR HUMIDITY; TRAFFIC; SIGNAGE OR LACK THEREOF; AND ROAD OR PATH CONDITIONS; AND ALL SUCH RISKS BEING KNOWN AND APPRECIATED BY ME. HAVING READ THIS WAIVER AND KNOWING THESE FACTS AND IN CONSIDERATION OF ATTENDING OP RC EVENTS I, FOR MYSELF AND ANYONE ENTITLED TO ACT ON MY BEHALF, WAIVE AND RELEASE OP RC AND ITS DIRECTORS, CAPTAINS, OFFICERS, SUB-CONTRACTORS, VOLUNTEERS, EMPLOYEES, AGENTS, MARKETERS, CLUB MEMBERS, DESIGNEES, SPONSORS AND THEIR REPRESENTATIVES AND SUCCESSORS FROM ALL CLAIMS, ACTIONS, DAMAGES, COSTS, EXPENSES, OR LIABILITIES OF ANY KIND ARISING OUT OF MY PARTICIPATION WITH OP RC, EVEN THOUGH THAT LIABILITY MAY ARISE OUT OF NEGLIGENCE OR CARELESSNESS ON THE PART OF OP RC AND THE ENTITIES OR PERSONS NAMED IN THIS WAIVER.
This liability waiver shall be governed and construed in accordance with the laws of the state of Delaware.
Ownpace run CLUB media release
I further grant OwnPace Run Club (“OPRC”), including any contractors, vendors, photographers, videographers, or media professionals hired or selected by OPRC, a non-revocable permission to capture my image and likeness in photographs, videotapes, motion pictures, recordings, or any other media (collectively, “Images”).
I acknowledge that ownership of the Images may be retained by the individual or entity capturing them, subject to any applicable agreement with OPRC. Regardless of ownership, I grant OPRC a perpetual, worldwide, royalty-free, and unrestricted license to copyright, display, publish, distribute, use, modify, print, and reprint the Images in any manner related to OPRC and/or OPRC business, including but not limited to social media, marketing platforms, publications, promotions, advertisements, brochures, websites, and other electronic displays or transmissions.
I waive any right to inspect or approve the Images or their use prior to publication and waive any right to compensation or profit arising from the use of the Images.
I hereby release, discharge, and hold harmless OPRC, its contractors, agents, representatives, assigns, and affiliates, from any and all liability, claims, or causes of action arising out of or related to the use of the Images in any medium, including but not limited to claims for invasion of privacy or right of publicity.
